Me and my husband are being legally seperated and wanted to know how Child Custody would work?
My husband and I have been having many problems lately so we have decided that it's best for us to be legally separated. We have a 13 month-old baby and I want to know if I can have full custody of him but allow my husband to have him on weekends.

Separation custody is a major issue for many couples planning on separation. How does legal separation and child custody work? The Child Custody matter will be decided in the court room and depends on a variety of factors on a case by case basis which surround in fulfilling the “best interests” of the Child. This depends on important factors such as which parent would be most supportive as well as capable in caring for the Child and thus become the Custodial parent. Visitation rights for the other parent can then be designated at that point. If the weekends are mutually agreeable by both you and your Husband, then that request should more than likely be accommodated. However, if there are any disagreements or disputes on Child Custody and Visitation, it may be advisable to contact a Divorce Attorney to help advocate your case.
