Finding a Lawyer in Nevada

If filing for divorce in Nevada, or any state, it is a good idea to find a lawyer to represent you in court and for any other proceedings associated with the divorce.  Meeting with several lawyers will help you find the one who will provide you with the best representation.

While knowledge of Nevada's divorce laws is crucial, your lawyer's familiarity with any other laws that may pertain to your case is also important.  Your lawyer will help you make sure that you meet all the requirements for filing for divorce in Nevada, as well as assist in gathering and completing documentation required by the court.

Consulting with a Lawyer in Nevada

In order to receive the best representation possible, it is important to be completely honest with your lawyer about all the aspects of the divorce.  If you hold back information, even if it reflects negatively on you, it could impede your lawyer's ability to represent your side of the divorce effectively. Nevada is a no-fault state, which means that blame cannot be assigned for the end of the marriage, which is all the more reason to divulge everything to your lawyer.

Custody and Child Support in Nevada

The Nevada courts believe that it is usually in children's best interest to have ongoing and frequent contact with both parents. While joint custody is preferred, the court will not support it if it is not in the children's best interest.  In joint custody cases, the exact time split between the parents is determined by what is best for the children.

Nevada requires that minor children be supported monetarily by both parents.  The amount of support the non-custodial parent is ordered to contribute is determined by several factors.  The amount of time the children spend with each parent is one of the primary factors considered.  The non-custodial parent pays money to offset the cost of the shelter, food, and clothing being provided by the custodial parent.  The earning potential and the amount actually being earned by each parent will also be factored in to any court-ordered child support payments.

Division of Marital Assets in Nevada

A community property state, Nevada considers all income of either party or assets purchased with that income during the course of the marriage to be equally owned by both parties.  As such, upon the dissolution of the marriage, the marital assets are divided equally between the parties.  In the event that the parties cannot reach an agreement on how to equally divide the marital assets, the court can make the decision for them.  The court has the right to make unequal distribution depending on the circumstances.  Such decisions will be explained in writing by the court.  The court can also decide on the method in which residences held by both parties will be equitably shared.  Often, one party will be ordered to pay the other party for their share of the jointly held residence.
