New York Residency Requirements

There are residency requirements that must be met in order for a couple to be able to file for divorce in New York.  The requirements include the following:

  • The marriage occurred in the state of New York and either party has been a New York resident for a minimum of 1 year prior to the petition being filed
  • Either party has been a New York resident for a minimum of 2 years prior to the filing of the petition
  • The reason for the divorce occurred in New York and either party has been a New York resident for a minimum of 1 year prior to the filing of the petition
