Are you wondering if you and your future spouse should sign a Pre-nuptial agreement? There are many reasons for couples to sign a Pre-nuptial agreements. Some of the reasons include:

  1. It is important for you to keep property (i.e. heirlooms, family business, future inheritance, etc). in the family.
  2. You want to define how property will be divided upon divorce.
  3. You want to protect each other from the debts of the other person.
  4. You have children from a previous marriage and you want to make sure that your children inherit their share of your property.

Pre-Nuptial Agreement Requirements

  1. It is important that neither party be coerced or under duress when entering a Pre-nuptial agreement.
  2. The parties must disclose all assets and debts, so that the agreement will be seen as reasonably "fair."
  3. It is also important that both parties receive independent representation by lawyers.

While some people consider Pre-nuptial agreements a precursor to divorce, it should not be looked at in that light. Instead, people should think of the choice as one made out of love. You love each other so much that you are taking the time to plan for the future.
